The People's Procuratorate of Changzhi City, Shanxi Province, the original public prosecutor.
The appellant (the original defendant) Jia Jia, also known as Jia Fusheng, male, born in Tianjin on July 17, 1951, Han nationality, college education, cadres, household address of No. 41 West 4 row 1, Yan'an South Road, Changzhi City, Shanxi Province. He was criminally detained on October 22, 2009 on suspicion of desertion and arrested on November 20 of the same year on suspicion of inciting subversion of state power. He is now detained in Changzhi City Detention Centre.
The Intermediate People's Court of Changzhi City, Shanxi Province, heard the case in which the People's Procuratorate of Changzhi City, Shanxi Province, charged the trial defendant Jia Jia with the crime of inciting subversion of state power, and issued a criminal verdict on October 8, 2010 (2010) No. 27 of the Changzhi Criminal Court. The trial defendant Jia Jia appealed to this court. The Court formed a panel according to law, through the file, arraignment of the trial defendant, that the facts of the original verdict is clear, decided not to hold a trial, and now the trial is completed.
The original examination showed that in October 2006, the defendant Jia Jia took advantage of the opportunity to travel to Taiwan, leaving the group in Taiwan, has roamed in Hong Kong, Taiwan, Malaysia, Indonesia, New Zealand and other places. While abroad, Jia Jia wrote and compiled 10 articles, including "Overthrowing Communist Tyranny and Realising Democracy in China is the Greatest Cause of Humanity," "Defeating the Communist Party is the Only Option for the Chinese People," and "The Chinese People's Public Enemy, the Central Committee of the Communist Party of China in Beijing," and uploaded all of them to "epochtimes.com," "boxun.com," and other overseas websites, in order to create a false narrative. All of these articles were uploaded to foreign websites such as "epochtimes.com" and "boxun.com", attacking our Party, government and national leaders in the form of disinformation and slander, and inciting subversion of state power and overthrow of the socialist system in China. Jia Jia created and promoted the "Chinese Democratic Federal Republic" and the "Chinese Democratic Core Party", and engraved the seal of the "Government Seal of the Chinese Democratic Federal Republic". At the same time, Jia Jia colluded with Falun Gong members outside of China and promoted his speech by participating in the organisation's resignation rallies; he contacted "pro-democracy" activists outside of China through the Internet and was elected "Vice President of the Chinese Transitional Government. "On October 22, 2009, Jia Jia returned to China from New Zealand and was arrested at Beijing International Airport.
The above facts are proved by the following evidence adduced and examined by the court.
1. The Notice of the Public Security Bureau of Shanxi Province on the Investigation and Investigation of Jia Jia's Illegal Activities Abroad proves that the defendant Jia Jia travelled to Taiwan with a group in October 2006, but left the group after arriving in Taiwan and stayed abroad for a long time without returning. Jia Jia's behaviour is suspected of endangering national security, and the Changzhi Public Security Bureau was designated to investigate the case in accordance with the law.
2, the witness Jia Gengchen (formerly the manager of the Nangong business department of Shanxi Province China Travel Service) testimony, Changzhi City Public Security Bureau domestic security detachment on the procedures for Jia Jia to Taiwan, the capture certificate, entry and exit records query, border control object notification, specific person entry and exit control form, transfer case notification, decision letter on the seizure of passport documents, information on the issue of capture and other evidence: October 2006 In the middle of 2006, the defendant Jia Jia with the relevant departments of the Shanxi Provincial Government documents through the Shanxi Province China Travel Service Nangong business department for the study tour to Taiwan, now the relevant procedures have been difficult to find. On October 22, 2009, Jia Jia returned to China from New Zealand and was arrested at Beijing International Airport. The staff rushed to Beijing to capture Jia Jia and criminal detention.
3. The search transcript, the evidence extraction transcript, the list of documents and relevant photos of the seized items by the Changzhi Public Security Bureau, the power of attorney, the report of the translation conclusion and relevant attachments prove that: under the witness of the witnesses, the items carried by the subject Jia Jia were searched and the relevant items were seized according to the law. The items seized included one seal of the Government of the Democratic Federal Republic of China, one ID card, one entry/exit permit for Taiwan, one New Zealand driver's licence, one mobile hard disk, one USB flash drive, one laptop computer, one power adapter, one mouse, one microphone, and one passport of the People's Republic of China. 1 microphone, 1 passport of the People's Republic of China, 3 pages of UNHCR documents, 5 pages of copies of UNHCR documents.
The defendant Jia Jia signed to confirm that the "Seal of the Government of the Democratic Federal Republic of China" was engraved by him in Taiwan in December 2006.
4. The articles "Overthrowing Communist Tyranny and Realising Democracy in China is the Greatest Cause of Humanity", "Defeating the Communist Party is the Only Choice of the Chinese People", "The Public Enemy of the Chinese People, the Central Committee of the Communist Party of China in Beijing", "Open Letter to the Political Bureau of the Communist Party of China to Discourage Dismissal", "Announcement of the Government of the Chinese Democratic Federal Republic" (No. 1), "Celebrating the First Anniversary of the Birth of the Chinese Democratic Federal Republic", "Party Cadres' Defection to Democracy and Freedom is I will return to my country to realise democracy in China", "I fully support and uphold General Fang Fenghui's political changes", and Defendant Jia Jia's signature confirms that these 10 articles were written, collected, or recorded by him, and that in the articles he calls himself a "reformist in the Chinese Party, government, military, and police", a "reformist in the Chinese Democratic Federal Republic", and a "reformer in the Chinese Democratic Federal Republic". In the articles, he identified himself as a "reformist in China's party, government, and military police," a "founder of the Chinese Democratic Federal Republic," a "vice president of China's transitional government," and a "member of the initiator group of the Future China Forum. In the above-mentioned articles, Jia Jia. was published on the websites of "Epoch Times" and "Bosun" after reading them out directly or publicly, respectively. In the above-mentioned articles, Jia Jia incited the subversion of state power in China and the overthrow of the Socialism system by means of disinformation and slander.
5. A News Story that Shames the Chinese", "Li Keqiang Visits New Zealand, Jia Quo Calls on Prime Minister Kai to Raise Jia Jia Issue", "New York Solidarity: Jia Jia's Return to China Can Inspire People to Face the Chinese Communist Party", "Chinese Transitional Government's Parliamentary Announcement on Jia Jia's Secret Detention on His Return to China", "Falun Gong" Shen Yun and Jia Jia Jiare Here for You", "Tibetan Citizens Support The First Vice President of the Chinese Transitional Government, Mr. Jia Jia, Returned to China to Save the People", and "Open Letter to President Obama", all published on the Epoch Times website and prepared by Wu Xue'er and others.
6, household registration materials, cadres resume, cadres transfer letter, Shanxi Province Science and Technology Experts Association letter, Jia Jia basic information materials, Shanxi Province Science and Technology Commission letter, Guan Gan set up "Shanxi Province Science and Technology Experts Association" application report, application for registration of social organisations, social organisations legal representative registration form, witness Nie Baoping (Deputy Director of the Shanxi Provincial Transportation Administration) testimony, Taiyuan Hongfeng Property Management Co., Ltd. testimony, Hongfeng Property Management Co. And prove that Jia Jia had other circumstances and the establishment of the Shanxi Province Science and Technology Experts Association related to the situation.
7, the defendant Jia Jia confession and its materials submitted at the trial to prove: he went to Taiwan with the group on October 18, 2006, to Taiwan Taoyuan airport after leaving the group, and then moved around Hong Kong, Taiwan, Indonesia, Malaysia, New Zealand and other places. During that time, he wrote 11 articles, including "Defeating the Communist Party is the only choice for the Chinese people" and "Ending Communist tyranny is the greatest cause for mankind", which were transmitted via the Internet to the overseas websites "boxun.com" and "epochtimes.com" for publication. The idea is to form a "Chinese Communist Party". His idea was to form the "Chinese Democratic Core Party" and establish the "Chinese Democratic Federal Republic" to realise democracy and the reunification of the motherland, and he announced the establishment of the "Chinese Democratic Federal Republic" in Taiwan. He announced the establishment of "Chinese Democratic Federal Republic" in Taiwan, and later he engraved an official seal of "Chinese Democratic Federal Republic Government" and used it in his homecoming articles, this is his idea, he did not organise and implement it. During his stay overseas, he mainly contacted "Falun Gong" reporter Wu Xue'er, who took him to "Falun Gong" resignation rallies and spoke to promote his ideas. The "pro-democracy activist" contacted her through the Internet, and at her repeated requests, she became the "vice president" of the "transitional government".
The forensic record proves that the defendant Jia Jia opened the website "Dynamic.com", which is a hostile website outside of China, and opened eight articles published on the websites of "epochtimes.com" and "boxun.com" by means of technical wood. The eight articles were saved and burned into CD-ROMs, and the whole forensic process was videotaped.

The trial court found that defendant Jia Jia had actively incite others to subvert state power and the existing social system by publishing inflammatory articles on the Internet and participating in the withdrawal rallies organised by Falun Gong outside of China, which seriously endangered the security of the state and social and political stability, and that his conduct constituted the crime of inciting subversion of state power. Jia Jia committed a major crime and colluded with foreign organisations and individuals in the course of committing the crime, which should be punished severely according to the law. In accordance with the provisions of Article 105(2), Article 106 and Article 56(1) of the Criminal Law of the People's Republic of China, the defendant Jia Jia was sentenced to eight years' imprisonment and two years' deprivation of political rights for inciting subversion of state power.
The appellant Jia Jia appealed that he did not incite subversion of state power, did not collude with people outside the country, and that the activities he engaged in were lawful, and requested the People's Court of Second Instance to impose a lighter penalty or change the sentence to acquittal.
The trial found that in October 2006, after the appellant had left the tour in Taiwan, he roamed around Hong Kong, Taiwan, Malaysia, Indonesia, New Zealand, etc., and wrote and compiled 10 articles, including "Overthrowing the Communist Tyranny and Realising Democracy in China is the Greatest Cause of Humanity", "Defeating the Communist Party is the Only Option for the Chinese People", and "The Public Enemy of the Chinese People, the Central Committee of the Chinese Communist Party in Beijing". All of these articles were uploaded on overseas websites such as "epochtimes.com" and "boxun.com", attacking our Party, government and national leaders in the form of disinformation and slander, inciting subversion of our state power, overthrowing the Dukkha system, and creating and promoting He created and proclaimed the "Chinese Democratic Federal Republic" and the "Chinese Democratic Core Party", engraved the seal of the "Seal of the Government of the Chinese Democratic Federal Republic", and colluded with "Falun Gong" elements outside of China. The fact that he was elected as the Vice President of the Transitional Government of China is clear, as is the fact that he colluded with Falun Gong elements outside of China, propagated his speech by participating in the organisation's rallies to resign from the party, and contacted "pro-democracy" activists outside of China through the Internet. The facts and evidence found in the second trial were the same as those in the first trial.
The Court held that the appellant Jia Jia actively incited others to subvert China's state power and socialist system by publishing inflammatory articles on the Internet and participating in the withdrawal rallies organised by Falun Gong outside China, which seriously endangered national security and the political stability of the Duchy. He should be punished. Regarding the reasons for his appeal that he did not incite subversion of state power, etc., after investigation, according to Appellant Jia Jia 's confession and his ten articles published on overseas websites, such as "Overthrowing Communist Tyranny and Realising Chinese Democracy is the Greatest Cause of Humanity", it is fully proved that he published inciting articles outside of China that are hostile to and defame China's state power and socialist system, created and preached "He created and promoted the "Chinese Democratic Federal Republic" and the "Chinese Democratic Core Party", actively incited others to subvert China's state power and the current socialist system, and participated in Falun Gong-organised resignation rallies outside China. The Court does not support his claim that he did not incite subversion of state power, which is inconsistent with the facts. The original judgement found that the facts were clear, the evidence was sufficient, the conviction was correct, the sentence was appropriate, and the trial procedure was lawful. In accordance with the provisions of Article 189(1) of the Criminal Procedure Law of the People's Republic of China, it is ruled as follows.
The appeal is rejected and the original verdict is affirmed.
